What is PHI and ePHI?
Protected Health Information (or PHI), is any information that can be used to identify an individual relative to a healthcare service, such as diagnosis or treatment. Common identifiers include names, birth dates, phone numbers, etc. Electronic Protected Health Information (or ePHI), is any health information which is stored, accessed, transmitted or received electronically. The data created by Digital Wellness Group’s telehealth, electronic charting system, testing services, and measurement-based care application, constitute ePHI.
Who needs to comply?
Any organization that handles PHI must be HIPAA compliant. This includes covered entities, which are individuals or organizations providing treatment, operations, and payment services in healthcare. Examples of covered entities are hospitals, practitioners, insurers, and healthcare plans like Medicare and Blue Cross. If you are a healthcare provider (i.e., doctor, therapist, clinician, practitioner), you are a covered entity.

What Is A Medical Professionals Agreement?
The Medical Professionals Agreement is an addendum to our existing terms of service. It clarifies that Digital Wellness Group furnishes healthcare technology services, not a provider of medical services, and that the providers using Digital Wellness Group are medical professionals who adhere to all the regulations per HIPAA.
Why Should I Care?
The federal government has the latitude to impose both civil monetary fines and criminal punishments upon individuals and organizations that violate HIPAA. Under the current omnibus HIPAA rules, each violation can incur a penalty up to $50,000, with repeat violations of the same provision costing as much as $1.5 million per year.
What Is A Business Associate
Any individual or organization that creates, receives, transmits, or maintains protected health information (PHI) on behalf of a covered entity or another business associate. These include vendors such as health technology companies, lawyers, and accountants. Comprehensive and complete business associate agreements are important to every healthcare organization’s HIPAA compliance plan. If a company will not sign an appropriate BAA with your organization, then you should not trust them with your patients’ PHI. Digital Wellness Group is a Business Associate.
